1. Acceptance of these Terms
These Terms form a binding agreement between you and RareCapture by LF Labs. They apply to every visitor, guest, customer, photographer, organizer, administrator, and other user of the Service.
If you do not agree to these Terms, you must not access or use RareCapture.
2. Scope of the Service
RareCapture provides software and digital infrastructure for uploading, organizing, processing, searching, viewing, sharing, and downloading event photographs and related media.
Features may include AI assisted photo matching, gallery delivery, camera to cloud workflows, guest access links, analytics, branded experiences, and communication integrations. We may update, improve, or discontinue features at any time.
3. Eligibility, Accounts, and Acceptable Use
You must have legal capacity to enter into these Terms. If you use RareCapture for a business or event organizer, you represent that you are authorized to act on that entity's behalf.
You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account or access link.
- Provide accurate, current, and complete information.
- Use the Service only for lawful purposes and only in connection with media you are permitted to upload, manage, or access.
- Do not interfere with the Service, bypass security controls, scrape data, reverse engineer core functionality, or attempt unauthorized access to other users' galleries or data.
- Do not upload unlawful, infringing, deceptive, abusive, or harmful content.
4. Selfies, Photos, and Biometric Processing
Certain RareCapture features use selfie based and face matching technology to help locate images in which a person appears. By submitting a selfie or enabling such features, you instruct us and applicable event operators to process the image for matching, gallery delivery, fraud prevention, security, and service improvement purposes permitted by law.
Where required, you are responsible for obtaining any legally necessary notice, consent, or authorization from the individuals whose data or images you submit. Retention periods, gallery availability, and download permissions may vary by event, organizer settings, contract terms, and applicable law.
- A submitted selfie may be converted into a facial template or similar technical representation for matching.
- Matching results are probabilistic and may be incomplete, inaccurate, or unavailable.
- RareCapture is not responsible for the independent privacy or consent practices of event organizers, photographers, venues, or other third parties.
- You must not use RareCapture to identify, profile, monitor, or target individuals in a manner prohibited by law.
5. User Content and Licenses
You retain ownership of content you upload or submit, subject to the rights you grant in these Terms. You grant RareCapture a non exclusive, worldwide, limited license to host, store, reproduce, process, adapt, transmit, and display your content as necessary to operate, secure, improve, and provide the Service.
You represent that you have all rights, permissions, and lawful bases necessary to upload the content and to grant the foregoing license.
- We may remove or restrict content that violates these Terms, applicable law, or the rights of others.
- We may generate thumbnails, previews, derivatives, or technical transformations required for delivery and performance.
- Except as expressly permitted, you may not copy, resell, sublicense, or commercially exploit the Service, software, branding, or documentation.
6. Fees, Billing, and Refunds
Some RareCapture plans or features may be offered on a paid, subscription, usage based, or custom contract basis. Unless otherwise agreed in writing, fees are due in the currency and on the schedule presented at the time of purchase.
Taxes, duties, and third party transaction fees may apply. Except where required by law or expressly stated in a written commercial agreement, payments are non refundable.
- We may change pricing for future billing periods with reasonable notice.
- If a payment method fails or an invoice remains overdue, we may suspend access to paid features until payment is completed.
- Organizer specific purchases, enterprise contracts, and pilot programs may be governed by separate order forms or service agreements.
7. Third Party Services and Availability
RareCapture may rely on or integrate with third party hosting, cloud storage, payment processors, camera transfer tools, communication providers, analytics platforms, and identity or messaging services.
We do not control and are not responsible for third party services, hardware, networks, or websites. Temporary downtime, latency, data loss, or feature interruptions may occur due to maintenance, outages, event connectivity limits, or factors outside our reasonable control.
8. Data Storage, Event Expiry, and Deletion
Event galleries are not stored indefinitely. Organizers are responsible for setting an expiry date for each event gallery. When an event reaches its expiry date, it is moved to the platform's Trash, and data in the Trash is permanently and irreversibly purged after 30 days — including photographs, derived facial representations, and associated records — from our servers and cloud storage.
RareCapture holds no liability for any data, photos, or records lost due to this automated permanent deletion process. It is the organizer's responsibility to download and back up any data they wish to keep before the 30-day Trash retention period ends.
9. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, RareCapture is provided on an 'as is' and 'as available' basis without warranties of any kind, whether express, implied, or statutory.
To the maximum extent permitted by law, RareCapture and LF Labs will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, business opportunity, or anticipated savings arising from or related to the Service.
- We do not warrant uninterrupted availability, permanent storage, error free matching, or that the Service will meet every business, legal, or technical requirement.
- Our aggregate liability for claims relating to the Service will not exceed the amount you paid to RareCapture for the applicable Service in the 12 months preceding the claim, or USD 100 if you have not made any payment, unless mandatory law requires a different result.
10. Suspension, Termination, and Changes
We may suspend, restrict, or terminate access to RareCapture immediately if we believe there is a security risk, a violation of these Terms, non payment, suspected unlawful conduct, or misuse of the Service.
We may update these Terms from time to time. When changes are material, we will post the revised version and update the last updated date. Your continued use after the effective date of revised Terms constitutes acceptance of the updated Terms.
11. Governing Law and Contact
These Terms are governed by the laws applicable to the RareCapture contracting entity, without regard to conflict of law principles, unless mandatory local law requires otherwise. You agree to cooperate in good faith to resolve any dispute before initiating formal proceedings.
